Cotality Campus Terms and Conditions
1. Definitions
In these Terms and Conditions:
On Demand Videos means the pre-recorded videos on available Products, viewable by you at any time on demand, located on the Website.
Intellectual Property Rights means all industrial and intellectual property rights throughout the world protected or recognised at Law and includes all current and future registered and unregistered rights relating to (a) trade marks, business names, domain names, copyright works, databases, software, circuit layouts, designs, patents, trade secrets, know-how, inventions and discoveries, and all other intellectual property as defined in article 2 of the convention establishing the World Intellectual Property Organisation 1967; and any application or right to apply for the registration of any of the rights referred to above.
Law means common law, principles of equity, and laws made by parliament (laws made by parliament include State, Territory and Commonwealth laws and regulations and other instruments under them, and consolidations, amendments, re-enactments or replacements of any of them).
Organiser means RP Data Pty Ltd as the owner, organiser, and licensor of the Products, its affiliates and/or Related Body Corporates.
Partner means any third party who provides On Demand Videos, Training Sessions or Training Materials on behalf of the Organiser, made available on the Website or Other Website (as defined in clause 4).
Product means the Organiser’s RP Data product, RiTA product and any other Organiser owned or licensed products; or Partner products or services, as advertised or included from time to time on the Website.
Training Session means the live webcasting of Product related training and development sessions as advertised on the Website.
Training Material means the specific Product related materials and collateral shown during the Training Session(s) or provided before, during or after the Training Session(s) by the Organiser (or Partner, as the case may be).
Website means Cotality Campus website (www.campus.cotality.com)
2. General
- These Terms and Conditions (and the versions amended from time to time) apply to the receipt and purchase of Training Session(s) and/or viewing of On Demand Videos and/or the use of Training Materials.
- By clicking ‘I Agree’ when accessing the Website or purchasing a Training Session, you have accepted the terms set out in these Terms and Conditions, which are current as at the time you click ‘I Agree’. These terms supersede any other agreement, whether verbal or written, by any person, sales agent or sales distributor of any member of the Organiser.
- Your attendance at the Training Session(s) and use of On Demand Videos and Training Materials is conditional on you accepting these Terms and Conditions. Acceptance binds you and the organisation(s), entities or persons you represent, and all of your personnel to these Terms and Conditions for the purposes set out in this point.
- If you do not accept these terms and conditions then do not view, download, install, copy or use the On Demand Videos, Training Session(s) and Training Materials, as applicable.
- You acknowledge and agree that the Training Session(s) will be recorded, and as such, you agree that will include recordings of your image, voice and likeness. In the event you do not agree to this clause, please reach out on campus@cotality.com.
- All prices displayed on the website are in Australian Dollars and inclusive of GST, unless otherwise indicated.
- Any discounts or promotional pricing are only offered for the timeframe specified alongside the promotion. Discounts or promotional pricing cannot be applied to Training Session(s) already purchased.
- Accessing the Website:
- if you are a current RP Data or Property Guru customer, you will be required to use your current login details; or
- where the above does not apply, create your own account, to access the Website to purchase (including rescheduling or cancelling) Training Sessions or access On Demand Videos.
- Description of the Training Sessions or On Demand Videos or Training Materials and any other goods or services on offer may be subject to change or correction at any time (including any associated pricing). Although the Organiser seeks to ensure the information is correct, the Organiser makes no representation or warranty as to whether the information being accurate or complete. If the Organiser discovers an error in pricing, the Organiser will try to notify you as soon as possible and allow you to cancel your order and obtain a refund if desired. You may be required to provide your credit card details to the Organiser for the purpose of issuing a refund to your credit card account in the amount of any cancelled order.
- By submitting an order via the Website, you warrant that:
- you are capable of entering into a legally binding contract with the Organiser,
- you are authorised and able to make payment via the method provided on the Website,
- the payment information you have provided is accurate and correct, and
- your purchase is not made for the purpose of commercial resale.
- Except as otherwise expressly provided, the Training Session(s) and Training Material(s) are provided to you on an ‘as is, as available’ basis without any representations or warranties of any kind, either express or implied, including any implied warranties of merchantability, fitness for particular purposes, title, non-infringement, security, availability, accuracy, or otherwise.
3. Payment method
- Payment can be made with a valid credit card (Amex, Visa, Mastercard) via the Website at the time of purchase. The Organiser will deduct all amounts at the time of processing your order.
- If the Organiser is unable to deduct from your credit card the total amount owing to the Organiser in one transaction, the Organiser may process any number of transactions on your credit card until the total amount owed to the Organiser is paid in full.
4. Delivery
- All Training Sessions will be delivered via Microsoft Teams. A link and details will be provided to you in a meeting invite (to your nominated email address provided at the time of purchase) once your order has been processed.
- Where Training Session are recorded (if available), such recordings will be made available on YouTube (or as otherwise specified by the Organiser) as soon as possible following completion of the Training Session (Recordings). A link will be provided via the email address used at the time of purchase.
- On Demand Videos will be viewable via the Website (or as otherwise provided by the Organiser).
- Organiser is (or its Partners are) the sole and exclusive owner of all rights, title and interests in and to the Training Materials, including any and all creations, inventions, modifications and Intellectual Property Rights subsisting in the Training Materials. You acknowledge and agree that:
- acquires no rights in or to the Training Materials or any Intellectual Property Rights in the Training Materials; and
- must not, and must not permit any other person or entity to, infringe upon, harm or contest the validity or Organiser’s and its Partners’ ownership of the Training Materials, or the creations, inventions and Intellectual Property Rights contained or embodied within the Training Materials.
- The trademarks, service marks and logos (Trade Marks) used in this Website are registered or unregistered Trade Marks of the Organiser or any related parties. No Trade Mark may be copied, reproduced, adapted or transmitted in any form or process without the owners consent.
- The Website may link you to other websites on the internet (Other Websites). These Other Websites are not under the Organiser’s control of, and you acknowledge that the Organiser is not responsible for the accuracy, copyright compliance, legality, decency, or any other aspect of the content of such Other Websites. The inclusion of such a link does not imply endorsement of the Other Websites by the Organiser or any association with its operators.
- Accessing those Other Websites is your decision and to the fullest extent permitted in law we are not responsible or liable in any way for:
- your use of those Other Websites or any loss or damage incurred arising out of or in connection with your use of them; and
- the content or practices of those Other Websites operated by third parties that are linked to our Website.
5. Refund/cancellation policy
- If you notify the Organiser in writing more than 24 hours before the scheduled Training Session (other than On Demand) that you are unable to attend, you may choose to have a refund issued or nominate a replacement delegate to attend in your place instead.
- If you notify us of writing less than 24 hours before the Training Session that you are unable to attend, you may nominate a replacement delegate to attend in your place instead or reschedule the Training Session for another mutually agreed time, however no refund will be issued. For the avoidance of doubt, you will only be able to reschedule a Training Session once. If you are unable to attend the rescheduled Training Session, you will forfeit your refund.
- If you do not attend the Training Session without providing notice in accordance with this clause 5, you will forfeit the rights provided to you, including any refund.
- To request a refund, exchange, credit or for further information please send an email to campus@cotality.com.
- The Organiser intends to run the Training Sessions as advertised but reserves the right to cancel or make reasonable changes to the programs at any time. The Organiser will only cancel a Training Session in circumstances (not limited to) such as sickness (and no replacement is available); or technical issues (incapable of immediate rectification). In the event of cancellation in accordance with this point, the Organiser will offer a replacement Training Session or provide a refund (as elected by you).
6. Security
Unfortunately, no data transmission over the internet can be guaranteed to be totally secure but we endeavour to use our reasonable efforts to protect the personal information of Organiser users. Organiser uses a variety of physical and electronic security measures, including restricting physical access to our offices and firewalls and secure databases, to keep personal information secure from misuse, loss or unauthorised use or disclosure. However, Organiser will not be responsible for any unauthorised access to that information. If you are not comfortable sending any information over the Internet, please contact the privacy officer to discuss alternative methods for providing any information. Any personal information you give us will be dealt with in accordance with our privacy policy located at https://www.cotality.com/au/legal/privacy-policy
7. Photography
For any Training Session(s) attended and delivered in person, you acknowledge that your photo might be taken and you consent to the taking and use (including in any publication or production) of any such photo by us in whole or in part, and in conjunction with any words or drawings, in electronic or print form, for the sole purpose of promoting the Training Session(s).
8. Law
These Terms and Conditions are governed by and construed in accordance with the laws of New South Wales. The parties irrevocably submit to the exclusive jurisdiction of the courts of New South Wales.
